By using any product or service provided by Skypomedia ("we," "us," "our"), you agree to these Terms of Service. If you do not agree, do not use our services. These terms apply to all clients, users, and visitors.

As a client, you agree to:
Clients using our SMS review request product are solely responsible for ensuring that end customers have consented to receive text messages. Skypomedia provides the technical infrastructure — compliance with TCPA and carrier regulations is the client's responsibility. By using our SMS product, you represent that you have obtained appropriate consent from each recipient.
Payment terms are agreed upon individually for each client engagement. Setup fees are due before work begins. Monthly retainer fees are due on the first of each month. All fees are non-refundable unless otherwise agreed in writing.
All custom code, automation workflows, and systems built by Skypomedia for a client become that client's property upon receipt of full payment. Skypomedia retains the right to use general methodologies and non-client-specific know-how for other engagements.
Skypomedia is not liable for any indirect, incidental, or consequential damages arising from use of our services. This includes, but is not limited to, lost revenue, carrier delivery failures, third-party service outages (Twilio, Supabase, etc.), or actions taken by end customers in response to messages sent through our system. Our total liability for any claim shall not exceed the amount paid by the client in the 30 days prior to the claim.
Either party may terminate a service agreement with 30 days written notice. Skypomedia reserves the right to immediately terminate access if a client is found to be in violation of these terms, particularly regarding messaging compliance.
These terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes shall be resolved in the courts of Essex County, Massachusetts.
We may update these terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated terms. Material changes will be communicated directly to active clients.
